This page details the terms and conditions on which you are agreeing to enter into a Competition with Moray Golf Competitions. The following terms and conditions apply for all Competitions run by Moray Golf Competitions.

By entering a Competition you accept and are deemed to have read these terms. These Competition terms and conditions shall not create or be construed as creating any form of contract, joint venture or other agreement between you and the Promoter other than in relation to a Competition you have entered.

 

The Promoter reserves the right to amend or vary these terms and conditions from time to time and you must check them for changes because they are binding to you.

DEFINITIONS

(Promoter/We/our) – means Moray Golf Competitions ;

(Entrant/You/your) – means the participant;

(Competition(s)) – means the prize draw competition(s) entered through the Website by you, to which these terms and conditions apply;

(Prize) – means the specific prize awarded for a Competition in accordance with terms and conditions;

(Social Media) – means Facebook, Instagram and YouTube or any other social media platform upon which details of Competitions are displayed;

(Website) – means www.moraygolfcompetitions.co.uk

 

PRIZE DRAW COMPETITIONS

  1. COMPETITION

1.1. The Competition is organised and run by the Promotor.

1.2. The Prize Competitions are open to all persons aged 18 and over that are legally residing in the United Kingdom and Ireland, excluding the promoter or employees of the Promoter.

1.3. If you are under 18, you may not use this Site or our services. By using this Site, you represent and warrant that you are of legal age to form a binding contract and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Site.

1.4.  Upon submission all entries to the Competition will become the property of the Promoter and will not be returned.

1.5.  If it has reasonable grounds for believing that an Entrant has broken any of these terms and conditions or acted in a way that is reasonably considered by the Promoter to be illegal, the Promoter reserves the right to refuse or disqualify an Entrant.

1.6.  By entering one of our competitions, you agree to be contacted via Facebook or email.

 

SOCIAL MEDIA

The Competition is not endorsed, sponsored or administered by Social Media, nor is any Social Media associated with the Promoter in any way. All Social Media providers are released from any responsibility in relation to the Competition and the Promoter and any Entrant shall hold all Social Media harmless for any claim raised in relation to the Competition.

ENTRY

3.1. To enter a Competition the Entrant must first submit their email address by completing the relevant registration box on the Website. Where an Entrant does this they agree:

3.1.1.  to provide true, accurate, current and complete information as prompted by the relevant form; and

3.1.2.  that they will not impersonate any other person or use a false name that they are not authorised to use.

Knowledge, skill or judgment based entry

To enter a Competition the Entrant agrees that they must undertake a knowledge, skill or judgement based challenge. Entrants must successfully complete and/or satisfy the challenge to be eligible to enter in to the Competition(s) of their choice, and have the opportunity to win the prize.

3.2.  All Competitions will have a maximum number of entries available which will always be displayed. The entry prices and quantity available will be at the discretion of the promoter.

3.4.  By entering the Competition, the Entrant acknowledges that payment will be taken for each entry whether or not they successfully complete and/or satisfy the knowledge, skill or judgement based challenge, and thereby submit an entry and acknowledge that making payment to the Competition does not guarantee in any way that they will win the prize, or be refunded if they do not win, or under any other circumstances.

3.5.  Entrants recognise that they must exercise skill, knowledge and judgement in order to pick the correct answer to the knowledge and skills based entry.

3.6.  Entrants may still be charged if they fail to successfully complete and/or satisfy the knowledge, skill or judgement based challenge on the Website and only completed entries which contain the right answer will make it into the Competition draw.

3.7.  If entering on the Website, an Entrant will be asked to provide their secure card payment details to conclude an entry to the Competition. Once the entry is submitted, the Entrant’s payment card will be electronically accepted and securely processed by the promoters card payment supplier,Trust Payments.

 

3.9.  It is the Entrant’s responsibility to ensure that they have the authority and are able to pay any entry fee and the Promoter will not be held responsible for any interest fees or other charges incurred by the Entrant in relation to their bank or method of payment.

 

3.10.  All Entries to the Competition are final and no refunds shall be made at any time or for any reason.

 

3.11.  Entrants acknowledge and accept that no correspondence will be entered into about the result of the Competition following the determination of the Winner as described below and that the Promoter’s decision is final.

 

3.12.  In entering the Competition the Entrant has made their own decision through their own enquiries and legal advice where sought.

 

3.13.  Each Entrant agrees that the usual requirements under the Consumer Rights Act 2015 for any goods and services will not apply to this Competition.

 

3.14.  The Competition will close on a specified end date and time or when the full allocation of paid entries for the Competition have been sold, whichever comes first. In the event that all entries are sold before the specified end date, we reserve the right to bring forward the date of the prize draw.

 

3.15.  Participants will be able to select their own choice of ticket numbers (subject to availability). The full list of entries will be available to view on the website.  Anyone answering the skills based question incorrectly will not appear on the entry list.

 

3.16.  You will not be notified if your answer is incorrect or if you are not the winner of the Competition.  Full details will be available on the website including previous winners.

 

  1. FREE ENTRY

 

4.1. We may run a number of free entry competitions from time to time.  These competitions will run in the same format as other competitions but Entrants will be limited to one free ticket per person.  We reserve the right to change how free entry competitions are offered.

4.3.  Entrants may enter any other Competition for free by sending a postcard by First Class Post to: Moray Golf Competitions, 9 Greenfield Circle, Elgin, Moray, IV30 5NF. The postcard must contain the name of the Competition prize, along with the answer to the competition question, the Entrant’s full name, address, telephone number and email address. The postcard must not be enclosed in an envelope or other packaging. Only one free postcard entry will be accepted per Entrant. Any postcard received which attempts to enter the same competition more than once or to enter more than one Competition will be disregarded. Please note that some Competitions sell out on the same day they are launched so the postal entry may arrive after a Competition has sold out and would not be entered into the Competition. Sending a postcard entry does not guarantee entry into a Competition. Postcard entries must be received before the Competition closing date. Where postcard entries are entered to a Competition they will be additions to the total ticket allocation for the Competition and will not be deducted from the paid entry allocation. By entering via postcard you are accepting the Competition Terms & Conditions.

 

 

 

5. THE PRIZE

5.1.  The Promoter owns any prize offered from the time the Competition is running until successful handover to the Winner is completed as outlined below.

 

5.2.  The prize will only be that as awarded at the time of the draw, no alternatives will be offered under any circumstance, subject to condition 5.6.

 

5.3.  There is only one winner and the prize is for the named winner and cannot be given or transferred to any other person.

 

5.4.  Should a winner reject their prize for whatever reason, the Promoter is under no obligation to provide another.

 

5.5.  The prize is subject to availability, non-transferable and there are no cash alternatives.

 

5.6.  Should an advertised prize be unavailable, the Entrant agrees and accepts that they may be offered an alternative prize which is of the same or at a higher value, like for like.

 

Prize Delivery

 

5.7. Delivery and/or collection of the prize will be as agreed between the winner and the Promoter.

5.8.  Should a prize be collected, the winner will be required to provide proof of identity and proof of entry into the Competition at the time that the prize is collected which must match that of the details provided when entering the Competition. Should the winners details not match their entry the winner will not be eligible to accept the prize in accordance with the conditions of these terms, the Entrant will not receive the prize and the Promoter will act in accordance with condition 7.7.

 

5.9.  Delivery of the prize is not of the essence and the prize shall be deemed delivered:

 

5.9.1.  on arrival of the prize at the winner address, agreed in accordance with condition 5.7; or

 

5.9.2.  if collected by the winner, when the winner collects the prize from the Promoter.

 

5.10.  The Promoter shall not be liable for any delay in or failure of delivery caused by:

 

5.10.1.  the winner’s failure to provide the Promoter with adequate instructions for delivery;

 

5.10.2.  the winner’s failure to collect the prize (if agreed); or

 

5.10.3.  an event of Force Majeure.

 

5.11.  The Promoter will not guarantee the value and condition of the Prize at the time the winner receives the prize.

 

5.12.  Until delivered in accordance with conditions 6.7 full title and interest in the prize remains that of the Promoter.

 

5.13.  Should the prize be a specific item, the item will be dispatched within 7 days of the winner being chosen and details agreed in accordance with condition 5.8.

 

5.14.  Delivery of prizes will be free for delivery within mainland UK and Northern Ireland. For prizes delivered out with the UK and Northern Ireland, the Promoter reserves the right to request postage and delivery fees are paid by the Winner.

 

5.15.  We guarantee that every prize will be unopened with original and undamaged content.

6. THE DRAWS/WINNER SELECTION

 

6.1.  Winners of the competitions will be chosen at random from all Entrants whose entry in the

knowledge and skills based test has been completed correctly using Google’s random number generator. The draw will be streamed live on Facebook.

 

6.2.  The number generated decision is final. No disputes will be permitted.

 

6.3.  The winner will be chosen within 7 days of the Competition being closed.

 

6.4.  If the Competition has ended and the Winner chosen successfully then the prize will be transferred by the Promoter to the winner upon delivery.

 

6.5.  The Promoter will have no responsibility over the prize once delivery is completed.

 

6.6.  If the winner cannot be contacted by the Promoter within 30 days of being notified of their status as the winner by e-mail, telephone, Social Media or mail via the contact details submitted along with their entry, the winner will be disqualified. The original winner will have no claim to the prize once disqualified.

 

6.7.  Should the Winner be disqualified the Promoter at its discretion will:

 

6.7.1.  select an alternative winner using the random number generator who will then have 7 days to accept the prize following the same routes of contact as the original winner; or

 

6.7.2.  retain ownership of the prize.

 

6.8.  Winner of the main prize in a competition will be excluded from the subsequent runner up draw(s) for the same competition.

 

7. CLOSING/CANCELLING THE COMPETITION

 

7.1.  If the number of entries to the Competition does not meet or exceed the minimum number of entries required at the closing date, at the Promoter’s option the Competition will either:

7.1.1.  close and the proceeds will be deemed sufficient to award the prize; or

 

7.1.2.  be extended for a period of 7 days.

 

7.2.  The Promoter reserves the right to cancel the Competition at any time. Should the Competition be cancelled any proceeds raised at the time of cancellation will be refunded to entrants within a reasonable period of time.

 

7.3.  The Promoter reserves the right to cancel the Competition for any reason beyond its reasonable control following which Entrants will be refunded in full.  These refunds will be issued to the original payment method within 10 days.

 

7.4.  The “minimum number” of entries is the minimum number as stated on a Competition’s page that is required to be reached in order for the Competition to be run successfully and not subject to the conditions of this condition 8.

 8. LIABILITY

 

8.1.  Save for death or personal injury the Promoter will not be liable for any loss (including economic loss) suffered to or sustained by any person or property as a result of any act or omission of the Promoter, nor will their employees or their agents in developing, planning and running the Competition, distributing the prize to the Winner or following the distribution of the Prize.

 

8.2.  The Promoter accepts no liability for errors or omissions contained within the prize details, description or specification or any other part of the Website. It is the responsibility of each Entrant (and in particular the Winner) to satisfy themselves as to the accuracy of any such details and/or any content of the Website.

 

8.3.  The Promoter will not be liable for any loss suffered by an Entrant as a result of incomplete entries or failed computer communications or for any loss suffered as a result of use of the Website.

 

8.4.  The prize is deemed accepted upon delivery and the Promoter will not be liable for any loss or damage suffered or sustained by any person or property as a result of any use or misuse, negligent or otherwise, of the Prize once it has been delivered to the winner.

 

9. LINKS FROM OTHER WEBSITES

Links from the Website to other sites and advertisements are only for information. We do not accept responsibility for any other sites or any loss you suffer from using them.

 

10. DATA PROTECTION

10.1. The Entrant acknowledges that the Promoter may collect personal data, as defined in the data protection legislation when the Entrant enters a Competition. The Entrant authorises the Promoter to enter and store their Personal Data in its database to be used for future promotional purposes and in accordance with the Promoter’s privacy policy.

11. MISCELLANEOUS

11.1.  In accordance with the Privacy Policy, the winner agrees to allow the Promoter to display his or her full name and town of residence on its Website and social media for the purposes of announcing the Winner of the Competition within 24 hours of the Winner being determined.

 

11.2.  Upon delivery of the prize, the winner also agrees that they may be required to take or have taken photo(s) and or video(s) for promotional purposes, both directly after receiving their win and in the future as and when required. These photos and/or videos may be used in any future promotional material by the Promoter.

 

11.3.  The Promoter does not accept responsibility for entries which it does not receive due to failures in computer systems, other malfunctions, high Internet traffic, hardware failure, software failure, server faults or any other reason.

 

11.4.  An entry shall be declared void (without any refund being given) if the entrant engages in:

 

11.4.1.  any form of fraud (actual or apparent);

 

11.4.2.  fraudulent misrepresentation;

 

11.4.3.  fraudulent concealment;

 

11.4.4.  hacking or interference with the proper functioning of the Website;

 

11.4.5.  amending, or unauthorised use of, any of the code that constitutes the Website; or

 

11.4.6.  if the Entrant does not meet the conditions of entry.

12. GENERAL

12.1. Upon entering a Competition, all Entrants must submit all contact details as requested by the Promoter (which may include and are not limited to valid e-mail, UK or Northern Irish postal address and phone number) which will be used for the following purposes:

 

12.1.1.  to notify the Winner that they have won the Prize;

 

12.1.2.  to post the Winner’s full name and town of residence on the Website; and

 

12.1.3.  to comply with the Privacy Policy.

 

13. DISCLAIMER

All product, company/brand names, trademarks and logos used are the property of their respective owners. Use of them does not imply any ownership, affiliation with or endorsement by them.

You may not reproduce, copy, distribute, store or in any other fashion re-use material from the Website unless otherwise indicated on the Website or unless given express written permission to do so by us.

 

 

GOVERNING LAW AND JURISDICTION

The Entrants and the Promoter recognise that the Competition, its administration and all associated activities are governed by Scots Law and that the Courts of Scotland shall have exclusive jurisdiction in the event of any dispute arising out of the Competition or its administration.
